M&L obtains over $9 million judgment in Federal Court of Claims against the United States -
Moore & Lee, LLP has successfully represented a contractor prosecuting a disruption and cumulative impact claim that the federal government rejected based on release language contained in contract modifications. The legal distinctions between delay claims and disruption claims were asserted, along with the failure of the release language to expressly release the cumulative impacts of the changes on the base contract work. The United States Court of Federal Claims rejected the government's accord and satisfaction defense and awarded the contractor 100% of its claims. The Court's decision will have notable effects on government construction contractors' rights in prosecuting disruption and cumulative impact claims.
