Representative Experience
- Lead Trial Counsel for a commercial landlord securing a full recovery for breach of contract and specific performance. Also obtained full defense against cross-complaint seeking significant monetary damages based on tenant’s improper interpretation of rental increase contained in Lease Agreement.
- Trial Counsel for a real estate developer obtaining full recovery for multi-million-dollar specific performance claim where seller of property attempted to improperly cancel Real Estate Purchase Agreement.
- Trial Counsel for Elder Care Facility defending against multi-million dollar claim which resulted in settlement following Ms. Tramontano’s oral argument of a non-suit motion the day before jury deliberations.
- Lead Trial Counsel for cloud services corporation obtaining over half a million-dollar award at arbitration for breach of contract claims including recovery of attorney’s fees and costs.

Devon B. Moore
Ms. Devon B. Moore is a Principal in Moore & Lee, P.C.’s California office. Her practice is focused on the defense of corporate and individual long-term healthcare providers, including claims against skilled nursing facilities, residential care facilities for the elderly (RCFE), memory care providers, and hospice providers.
Devon has over 8 years of experience as an attorney in the long-term healthcare industry and has the unique and valuable experience of working as both a defense attorney and plaintiff attorney in this area of the law. Devon has effectively represented clients both for and against claims of elder abuse and neglect, dependent adult abuse and neglect, wrongful death, medical negligence, violation of patients’ rights, medical malpractice, personal injury, breach of contract, fraud, concealment, intentional and negligent infliction of emotional distress, exposure to COVID-19, breach of statutory duties, debt collections, and the negligent hiring, supervision, and retention of employees. She also has experience representing acute care hospitals and litigating against physicians. She has successfully assisted clients with case management, liability evaluations, litigation through trial, settlement negotiations, mediations, and conflict resolution.
Devon has worked as an attorney in various other legal fields, including representing contractors and subcontractors in construction defect claims and complex commercial litigation, homeowners’ association disagreements, property management law, premises liability, products liability, workers compensation, contract law, professional negligence, intentional torts, business law, sexual battery, assault, and criminal law, in addition to working as a certified law clerk at the Orange County Public Defender’s Office.
Devon is a Southern California native. She graduated from the University of California, Irvine, in 2012, earning a bachelor’s degree in Psychology. In 2015, she received a Juris Doctorate degree and graduated Cum Laude from Western State College of Law and passed the California bar exam. During law school, she was an intern at a law firm specializing in the long-term healthcare industry, achieved Honor Roll and a Merit Scholarship each year, a Witkin award, and a Criminal Law Certification with distinction. In 2016, Devon was admitted to the State Bar of California and the State Bar of Nevada. In 2017, she passed the Uniform Bar Exam making her eligible for admittance into twenty-eight additional State Bars.

She also enjoys traveling, attending concerts, museums, watching sports, the beach, and spending time with her husband and two dogs.

David J. Todd
David J. Todd is a Principal at Moore & Lee, P.C. His practice focuses on representing contractors, subcontractors, owners, developers, sureties, insurers, architects, and engineers in private and public construction disputes in state and federal court, arbitration, and mediation. Mr. Todd’s litigation experience includes a wide range of commercial, industrial, public works, and residential construction projects including office buildings, hotels, schools, apartment buildings, power plants, bridges, highways, condominiums, convention centers, hospitals, assisted living facilities, mixed-use projects, military and other government facilities, and public transportation projects. Mr. Todd also drafts and negotiates construction and design contracts, advises clients in contract administration, and prepares and evaluates claims arising in public and private construction contract settings.
In addition to construction disputes, Mr. Todd also represents clients in complex government contract disputes and commercial litigation. Similar to his construction practice, he has represented government contractors in disputes in state and federal court, arbitration, mediation, and at contract boards of appeals. Mr. Todd also has experience advising clients in commercial disputes, such as payment disputes, teaming agreements, non-compete clauses, non-solicitation clauses, landlord-tenant disputes, and Uniform Commercial Code (UCC) disputes.
Prior to becoming an attorney, Mr. Todd previously served as the firm’s senior paralegal in which he gained significant experience in all aspects of e-discovery while managing the firm’s complex and document-intensive construction, government contract, and long-term healthcare cases. Biography
As a Principal of Moore & Lee, P.C., Robert D. Windus focuses his practice on preparation of construction claims and resolution of disputes involving government contracts, bid protests and other commercial contracts. Since joining the firm, his construction litigation practice has involved the representation of multi-national clients in international arbitrations as well as domestic companies, owners, contractors and subcontractors.
Mr. Windus has extensive trial and appellate experience before numerous federal courts, state courts, governmental agencies, boards of contract appeal and arbitration bodies. Mr. Windus’ involvement in international dispute resolution has included matters before the London Courts of International Arbitration, International Centre for Dispute Resolution and International Chamber of Commerce. Additionally, his practice has included international project development and client representation involving matters in Australia, Bulgaria, India, Indonesia, Pakistan, Turkey, United Kingdom, Saudi Arabia, Singapore, Thailand, Afghanistan and the UAE.
Since the beginning of Mr. Windus’ professional career, he has been involved in the construction industry, first as a practicing engineer working for a mid-size contractor. His tenure started in the estimating division, assisting with the preparation of competitive and negotiated bids, including quantity estimation and pricing of work. Later, Mr. Windus moved to the field as an on-site Project Engineer and then as a Project Manager responsible for contractor compliance, change order negotiations, preparation/negotiation of claims and scheduling.
Mr. Windus has recently lectured on international construction litigation at the International Law Institute in Washington, D.C. He lectured at the Sheet Metal and Air Condition Contractors National Association (SMACNA) 69th Annual Convention in Las Vegas, Nevada. Mr. Windus presented lectures on “Avoiding Construction Claims in Litigation” and “The Measured Mile and Other Methods of Quantifying Loss of Labor Productivity in the Construction Industry. He was a contributor to the 2004 Mechanical Contractors Association of America’s Management Methods Manual, Change Orders, Productivity, Overtime, A Primer for the Construction Industry. He has lectured on topics such as management of contract risks and contract negotiation, preparation and defense of construction claims, and international arbitration. Mr. Windus has spoken as a frequent lecturer at the “Testimony and Trial Techniques” seminars given by the Consortium of Universities (Georgetown, George Washington, American, Catholic and Howard Universities) and by the Washington Metropolitan Transit Police Academy. He is the author of the case note Braswell v. United States – Another Chapter in the Collective Entity Doctrine, 14 U. Dayton L. Rev. 715 (1990).
